If you have been injured as a result of negligence or lack of care for your safety you are entitled to claim compensation even if you were partially to blame. Compensation for pain and suffering is assessed by reference to previously decided court cases and from guidance contained in a publication called "The Judicial Studies Guidelines". In addition compensation can also be claimed for any necessary change in lifestyle, for loss of congenial employment and for disadvantage on the open labour market.
- Special Damages are payable for actual past losses and estimated future losses and may include:
- loss of past income and loss of assessed future income
- care for the past and estimated care for the future
- gratuitous assistance
- medical expenses for the past and for the future
- loss of amenities of life
- prescriptions
- reduced employment prospects in the future
- expenses in relation to the claim
- Interest may be added to compensation awarded
