The Legal Aid Board can provide funding to pay for a
solicitor in civil cases. Most civil legal aid cases start with ‘advice and
assistance’ and if there appears to be a good case worth pursuing in the courts then an application for ‘civil legal aid’ can be made.
“Advice and assistance”
will pay for advice
from a solicitor on any matter of Scots law, however it will not normally cover putting your case in court.
“Civil legal aid” will provide funding for a solicitor to put a case in court. It covers the preparation work and the hearing in court and pays for court fees, advocates and
experts.
Civil Advice And Assistance. This covers a wide range of matters relating to Scots law and includes advice on divorce, contact with children, personal
injury claims, immigration or asylum issues, welfare rights etc, and entitles a
solicitor to:
- give advice on whether there is a legal case to take forward;
- negotiate with the other party to settle the matter;
- advise on whether an application for civil legal aid should be made to take the
matter to court;
- write letters or obtain reports.
Civil Legal Aid. This covers assistance in a wide range of issues including:
- actions for compensation for injuries resulting from an accident or
medical negligence;
- divorce and other family maters including children;
- immigration, nationality or asylum.
- housing matters such as rent or mortgage arrears, repairs, eviction & debt;
