In order for a victim of crime to succeed in a Criminal Injuries Compensation Authority application it is necessary for them to report the matter to the police promptly and thereafter to co-operate with the police investigation and any subsequent prosecution. It is not necessary for there to be any prosecution or for any prosecution to succeed in order to claim compensation.

The police will be ask your permission to being examined by a specially trained doctor who will be looking for forensic evidence as well as to see if you need treatment for any injuries. The examination may take place in a special room for victims of crime at the police station or in a hospital or at the doctors own surgery. The doctor who examines you will offer you the 'morning-after pill' and any other appropriate medical information or treatment.

To assist in the prosecution of a violent attacker it is necessary for the police to take a signed, written statement from any victim of crime. If you are 17 or younger, the police may prefer to make a video of your statement. If the attacker was a stranger, the police may show you photographs or create a sketch, photofit or videofit or you may be asked if you can pick them out of an identity parade where the police will usually arrange for you to be able to see the people on the parade without your being seen by them. Once all of the evidence has been gathered the Crown Prosecution Service, which is completely independent of the police, makes a decision on proceeding with the case based on whether or not there is a 'realistic prospect of conviction' for an offence of violence assuming a prosecution is in the public interest. If the defendant pleads not guilty to the crime, you may have to go to the Crown Court and appear as a witness. It is against the law for newspapers or television to use your name or give details that would identify you to members of the public.
