How long do I have to claim?
The normal rule is that a road traffic injury claim must be settled or proceeding must have been issued within three years from the date of the accident however, if you were under eighteen at the time of the accident then you have three years from the date of your eighteenth birthday.
Can I claim?
You are entitled to make a road traffic injury claim if you are not at fault or not entirely at fault and if some else is at fault for causing the accident. Passengers in particular have no difficulty in making a successful claim as they are almost never at fault for causing an accident. There are situations where both drivers are partly to blame for causing an accident and liability is often divided between them on a percentage basis entitling both to claim against each other.
What should I do after an accident?
- visit a doctor or a hospital for treatment and to make a record any injuries
- take photographs of any visible injury.
- obtain the address and telephone number of others involved in the accident
- note the registration number, make and model of all the vehicles involved.
- record the date and time of the accident, the street and city and weather and road conditions.
- obtain details of the insurance policies of all the parties involved.
- if the police are involved obtain the officers name and collar number.
- obtain witnesses names, addresses and telephone numbers.
- draw a diagram of the vehicles, people and property immediately before and after the accident
- take photographs of any damage to vehicles and the road layout which may change
How much compensation can I claim for my injury?
The value of pain and suffering in a road traffic injury claim depends on the severity of the injury, the length of time that the injury to heal and whether or not there are any long term effects. These elements are determined after consideration of medical reports usually obtained from medical consultants after examination and consideration of hospital and GP records.
What is quantum
This is the amount of the financial settlement and is usually classified into general damages and special damages.
What is general damages
This represents compensation for items that must be assessed because they cannot be precisely calculated and includes damages for pain and suffering.
What is special damages
This represents compensation for losses that can be calculated accurately including loss of earnings, out of pocket expenses, medical treatment, personal property and vehicle damage.
