This condition is characterised by discomfort following injury to the neck affecting the bones, discs, muscles, nerves or tendons. The injury is caused when the head is thrown backwards, forwards or sideways followed by reflex contraction in the opposite direction. If you have suffered from neck pain as a result of a road traffic accident that was caused by the negligence of someone else, you are entitled to make a whiplash compensation claim for personal injury and loss.

Compensation Awards
A whiplash compensation claim can result in very substantial financial awards which are categorised as follows :-
Special Damages concerns the losses in a whiplash compensation claim that can be determined with some degree of precision including loss of earnings, loss of future earning capacity, out of pocket expenses and damage to property both in the past and for future. If the accident has caused time off work, then there will be a claim for loss of earnings and a claim can also be made for future loss of earnings. Compensation can be awarded for "handicap on the open labour market", which means that if the person were to be dismissed from their job, then they would have difficulty in getting alternative employment. If family or friends have had to help carry out domestic tasks, then a claim can be made in respect of their time incurred. A claim can also be made for miscellaneous losses and expenses incurred.
General Damages are less able to be calculated accurately and often constitute the most significant award in a whiplash compensation claim. General damages include physical pain and suffering, emotional pain and suffering and loss of enjoyment of life. It is also possible to claim for psychological injuries such as depression, or post traumatic stress disorder. In order to assess the value of pain and suffering a medical consultant will prepare a written report on your injuries usually following examination and consideration of all medical records. This evidence is used to assess the value of your injury claim. The assessment of compensation for pain and suffering for whiplash injury following a road traffic accident includes consideration of the nature and severity of the personal injury and consequent symptoms, age, occupation, leisure activities, how it has affected your lifestyle and domestic responsibilities and whether there is any permanent disability. The amount of the award is based on previous awards made by other courts involving similar injuries and on information contained in a publication called 'The Judicial Studies Guidelines'.
