Catastrophic Injury Accident
Our catastrophic injury solicitors deal with the following types of claim and also handle many more less common problems including compensation following a fatal accident :-
- Slip and fall claims require specialist legal knowledge and experience. Lawyers who deal with slipping claims should have extensive experience of handling different types of slipping accidents. Falls from height are particularly dangerous with the victim often suffering spinal cord injury or brain impairment.
- Motor vehicle claims including claims for compensation for drivers, passengers, pedestrians, motorcyclists and bicycle riders. Our vehicle accident lawyers are personal injury specialists whose entire case load consists of nothing but motor claims. If it was someone else's fault then you are entitled to compensation even if the driver was a friend or relative.
- Accident at work claims are unfortunately an all too common fact of life. To ensure you establish liability and receive adequate compensation it is essential that you are represented by accident solicitors who are familiar with all issues relating to the protection of employees. A specialist will be able to interpret the complicated legislation is in place both from the UK parliament and from the EU to protect workers from injury.
- Occupational Illness affects thousands of people every year and the consequences can be devastating. Accidental exposure through lack of safety procedures to noxious substances or a harmful system of work can severely damage health. Even if exposure took place a long time ago you may still be able to make a claim. Our specialist solicitors are able to handle a wide variety of industrial disease matters and deal with thousands of occupational illness cases every year and can help you to get the compensation you deserve.
Catastrophic Injury - Life Changing Events
Catastrophic injuries have enormous impact on the lives of the individuals who experience them and include brain injury, spinal cord injury, accidental amputation, severe burns, multiple fractures and neurological disorders. Management of many of these serious injuries is complex and requires the expertise of a team of health professionals including physicians, consultants, nurses, therapists, and counsellors. Many victims experience permanent disability, significant suffering, and reduced life spans.
Assessment is required for some categories of amputation compensation including calculation of the value of pain and suffering and lifestyle changes. Assessment is carried out by a judge and is based both on decisions made in similar previous cases and on the judges own experience as a working lawyer.
The most common cause of accidental injury, which may give rise to a scar compensation claim relates to incidents that occur in the workplace caused by the negligence of the employer or a co-worker, whilst most facial scarring compensation claims result from motor vehicle accidents, particularly amongst passengers who fail to wear a seatbelt. In both cases, laceration injuries are common and the degree of scarring depends on the extent of the injury coupled to some extent with the individual’s propensity to either heal fully with minimal obvious effects or to develop disfiguring scars which may have a contribution from infection caused by inadequate health care.
A traumatic amputation is a life threatening event that can have devastating long term consequences. Whilst reattachment s sometimes a possibility, regaining full function is an entirely different matter and most reattachments result in mainly cosmetic benefit. Amputation compensations claims are intended to put the victim back into the position that they were in prior to the accident however clearly in the case of a lost limb this is a fatuous proposition but what amputation compensation will do is make everyday life a little easier for the victim. Damages for personal injury in amputation compensation claims are divided into two distinct categories :-
Burns & Scalds
Burns and scalds are frequently life threatening, often cause horrendous scarring and may result in fatality. Burn compensation claims for personal injury damages result from negligence by a third party, usually as a result of a motor vehicle collision or an industrial accident. Burns and scalds are often classified as catastrophic injury which can affect other organs of the body and frequently affects the nervous system, respiration, circulation, the urinary system and the gastrointestinal system and may cause restriction of movement, reduced sensation and communicative or cognitive abilities.
Most eye injury compensation claims arise from incidents in the workplace although a small percentage is also due to motor vehicle collisions and criminal assault. The most common injuries arise from exposure to irritant or caustic liquids and gases in an industrial environment and may be accompanied by severe facial scarring. Most irritants do not cause permanent damage however even a splash of strong acid or strong alkali can cause permanent and severe damage in a matter of moments. In both cases the strength of the solution that is capable of causing severe injury is well below the level commonly described as concentrated. Strong acids and strong alkalis are found in many industrial environments but are also encountered at home in the form of battery acid and brick cleaner (acid) or drain and oven cleaner (alkali).
A lesser cause of eye injury compensation claims relates to physical trauma of the eye or the eye socket or the bone adjacent to the eye which is caused by blunt instrument force usually as a result of a criminal assault, a motor vehicle accident or equipment failure whilst at work. Further injuries may also be caused in similar circumstances due to lacerations or corneal abrasions or foreign bodies in the eye which are a constant hazard for lathe workers.
A chronic pain compensation claim is not without legal complexity and medical difficulties. Whilst medical professionals do not doubt the existence of chronic pain, pinning down the cause can be an extremely difficult matter with various theories including complex pathological causes which may or may not have a psychological dimension. It is not realistically possible to ignore the emerging connection between severe physical injury and the development of chronic pain which has been defined as pain that persists six months after an injury, beyond the anticipated recovery date with no clearly definable cause. There are a number of conditions whose symptoms often satisfy this definition including chronic pain syndrome, fibromyalgia syndrome, fibromyalgia, lower back pain, reflex sympathetic dystrophy and myofascial syndrome.
Most fracture compensation claims arise out of motor vehicle collisions and accidents at work with falls from height being particularly in evidence. Fractures can be either closed in which case the skin is not broken or open where the skin is pierced by the broken bone making infection more likely. In general terms open fractures are usually the more serious due to higher risk and attract higher levels of compensation awards. The healing of broken bones may be slow with immobilisation often being necessary for many months thereby compounding financial losses making for some very substantial fracture compensation claims.
