There are four main potential scenarios for UK residents intending to make a Spanish accident compensation claim for personal injury as follows :-

    Air Travel Injury

    If you were injured whilst travelling on an aeroplane to Spain or whilst using either airport you may be able to claim compensation under the Montreal Agreement which merely requires you to prove injury without associated negligence. If for example a food & drink trolley ran into you due to turbulence or an item fell on you from an overhead locker you will be able to claim compensation for any injury sustained without the necessity of proving negligence against the tour company or airline operator.

    Package Holiday Accident

    If you have been involved in an accident in Spain whilst on a package holiday and the accident was directly connected to the package holiday, then you may be able to claim against a tour operator based in the UK. This may involve a car accident on transfer from the airport or ferry in Spain arranged by the tour operator, injury due to defective Spanish hotel premises, an accident in a car hired as part of the package or any other situation that has a direct connection to the company that arranged the package holiday. Bus tours are of course covered under this section and any incident resulting in injury caused by the negligence of the bus driver whilst travelling on a bus hired to a UK tour company is covered and a claim can be made against the UK tour operator.

    Other UK Resident Accident

    If you have suffered personal injury in a car accident caused by negligence involving another UK resident whilst in Spain, it is possible to take direct legal action in the UK and if necessary to issue proceedings in a UK court of law. The most common incident relates to a road traffic accident involving a vehicle collision between two independent UK holiday makers caused by the negligence of one or both car drivers resulting in personal injury.

    No UK Connection Accident

    In most other cases where there is no UK connection to an accident it will be necessary to instruct a Spanish lawyer to take action to claim compensation for personal injury following an incident involving a third party driver who has no UK connection. This usually means involving a resident of Spain however where the third party driver is resident in a country other than the UK or Spain we are often able to deal with the matter.

Accident Time Limits in Spain & UK

There are time limits on making a compensation claim for personal injury both in the UK and in Spain. You should not delay in contacting a lawyer or solicitor to deal with your compensation claim. Issues relating to time limits can be complex legal matters and there are many exceptions to the basic rules.
